# Lombardy Regional Law 11/2026: data centers on brownfield land

> Lombardy’s Regional Law 11/2026 is Italy’s first regional framework for data centers. It rewards building on **brownfield** land (construction charges cut by 10–30%, set by each municipality) and penalises farmland (charges doubled, tripled in protected areas). Data centers above 5 MW are treated as production facilities.

- Agricultural land: +100% surcharge; +200% in regional parks or areas of environmental significance (HLC).
- Data centers above 5 MW are classed as production facilities; up to 5 MW can be compatible with tertiary or office zoning (Osborne Clarke).
- Municipalities must map disused, contaminated and degraded areas within a year (BibLus).

## What it does not do
